Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of Haircut and related services (the “Services”) provided by Agentic Studios (“Agentic Studios,” “we,” “us,” or “our”). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Description of the Services

Haircut provides software for barbershops and related businesses, including scheduling, client management, payments and payouts (where enabled), communications, and related tools. Features may change over time. We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.

Eligibility

You must be able to form a binding contract in your jurisdiction and meet any minimum age requirements (typically at least 18, or the age of majority). If you use the Services on behalf of a business, you represent that you have authority to bind that business.

Accounts and security

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at hello@vibedevelopment.ai if you suspect unauthorized access.

Shops and client data

Businesses using Haircut (“Shops”) control the client and appointment data they enter. Shops are responsible for obtaining appropriate consent for marketing or automated messages, for the accuracy of client information, and for compliance with laws applicable to their business (including data protection and telemarketing rules). We process such data as described in our Privacy Policy and as directed by the Shop to provide the Services.

Fees, billing, and payments

Subscription or usage fees are described at checkout or on our pricing page unless otherwise agreed in writing. Payments may be processed by third parties such as Stripe. You authorize us and our payment partners to charge applicable fees to your payment method. Where Stripe Connect or similar is used for payouts to Shops, separate Stripe terms apply. Taxes may apply where required by law.

SMS and communications

The Services may allow Shops to send SMS or other messages to clients. Shops must comply with applicable rules (including consent, identification, and opt-out requirements).

Haircut SMS program (client messaging)

Program name: Haircut client SMS (messages sent on behalf of salons and barbershops using the Haircut platform).

Program description: Participating businesses may use Haircut to send text messages to clients who have voluntarily agreed to receive those messages (for example via an optional SMS consent action during booking). Consent to SMS is not required to use booking or complete a purchase. Message types can include appointment-related reminders and confirmations, rebooking or follow-up prompts, thank-you or review requests, and occasional promotional notices related to that business. Content and timing are controlled by the Shop; Haircut provides the software and delivery through integrated messaging providers (for example, Twilio).

Message and data rates: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Message frequency: Frequency varies based on each Shop's settings, appointments, and outreach (for example, reminders near a scheduled visit or occasional follow-ups). There is no fixed daily or weekly minimum or maximum—volume depends on how the Shop uses the feature and client activity.

Support contact: For questions about these Terms, the Services, or SMS delivery through Haircut, contact Agentic Studios at hello@vibedevelopment.ai. For questions about a specific Shop's messages, promotions, or appointments, contact that Shop directly using the contact information they provide.

Opt-out and help: You can cancel SMS from a participating Shop at any time by replying STOP to a message from that program. You will receive a confirmation text after you opt out. To receive help or information about messages sent via Haircut on behalf of a Shop, reply HELP to the message thread where available, or email hello@vibedevelopment.ai for platform support.

Acceptable use

You agree not to:

  • Violate any law or third-party rights.
  • Send spam, unlawful content, or misleading messages.
  • Attempt to gain unauthorized access to the Services, other accounts, or our systems.
  • Use the Services to distribute malware or interfere with operation of the Services.
  • Reverse engineer or attempt to extract source code except where permitted by law.
  • Use the Services in any manner that could harm our reputation or overload our infrastructure.

We may suspend or terminate access for violations.

Intellectual property

The Services, including software, branding, and content we provide, are owned by Agentic Studios or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You retain rights to content you submit; you grant us a license to host, use, and display that content as needed to operate and improve the Services.

Third-party services

The Services may integrate with third-party products (for example, Stripe, Twilio, or hosting providers). Your use of those services is subject to the third party’s terms and privacy policy. We are not responsible for third-party services we do not control.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTIC STUDIOS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE PROHIBITED BY LAW.

Indemnity

You will defend and indemnify Agentic Studios against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, your violation of these Terms, or your violation of applicable law—except to the extent caused by our gross negligence or willful misconduct.

Termination

You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, non-payment, risk, or legal reasons. Provisions that by their nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice (for example, by email or in-product notice). Continued use after the effective date constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles, except where preempted by federal law or where your jurisdiction requires otherwise.
